I. GENERAL PROVISIONS

  1. This regulation defines the rules for using the internet service available at the address: www.skyhigh.pl (hereinafter referred to as the „Service”).
  2. The owner and administrator of the Service is A.S.D. Skyhigh Water Sport Center, headquartered at Localita Porto Botte 1, 09010 Giba, CI Sardinia, Italy (hereinafter referred to as the „Administrator”).
  3. The use of the Service signifies the acceptance of this Regulation without restrictions or reservations.
  4. All trade names, company names, and logos used on the Service belong to their respective owners and are used solely for identification purposes. They may be trademarks.


II. DEFINITIONS

  1. Service – the internet service available at the address: www.skyhigh.pl.
  2. User – any natural person, legal entity, or organizational unit without legal personality using the Service.
  3. Regulation – this regulation of the Service.


III. RULES OF USING THE SERVICE

  1. The Service is available to Users without the need for registration.
  2. The User undertakes to use the Service in accordance with its purpose, applicable law, and the provisions of the Regulation.
  3. It is forbidden to use the Service in a way that:
    • violates the law,
    • violates the rights of third parties,
    • is harmful to the Administrator and other Users,
    • for commercial purposes without the prior consent of the Administrator.
  4. The Administrator reserves the right to:
    • temporarily or permanently restrict access to the Service in case of violation of the Regulation by the User,
    • introduce changes to the Service and its content,
    • temporarily disable the Service for maintenance or updates.


IV. PERSONAL DATA PROTECTION

  1. The Administrator processes the personal data of Users in accordance with applicable law, in particular with Regulation (EU) 2016/679 (GDPR).
  2. Detailed rules for the processing of personal data are set out in the Privacy Policy available on the Service.


V. COOKIES

  1. The Service uses cookies to ensure its proper functioning and for statistical and advertising purposes.
  2. The User can change the cookie settings in their web browser at any time.
  3. Detailed information about cookies can be found in the Cookie Policy available on the Service.


VI. FACEBOOK AND INSTAGRAM PLUGIN

  1. The website contains a plugin for the Facebook and Instagram social networks.
  2. The Facebook and Instagram plugins are marked with the respective Facebook and Instagram logos.
  3. This plugin directly connects to the Owner’s profile on the Facebook or Instagram server. Facebook or Instagram may then obtain information that the User has visited the website from their IP address.
  4. If the User visits the website while logged into their Facebook or Instagram profile, Facebook or Instagram will record information about the visit. Even if the User is not logged into Facebook or Instagram, Facebook or Instagram can still obtain information about the IP address.
  5. Facebook and Instagram do not provide the Owner with information about the data collected and how it is used. The purpose and scope of the data collected by Facebook and Instagram are not known to the Owner. For additional information regarding privacy on Facebook, Users should directly contact Facebook or Instagram or review the privacy policy of the portal at: https://www.facebook.com/about/privacy/
  6. If the User does not want Facebook or Instagram to collect information about their browsing of the website, it is advisable for the User to log out of their Facebook or Instagram account beforehand.


VII. RESPONSIBILITY

  1. The Administrator makes every effort to ensure that the information published on the Service is up-to-date and accurate, however, it does not assume responsibility for its timeliness, accuracy, and completeness.
  2. The Administrator shall not be liable for:
    • damages resulting from the use or inability to use the Service,
    • damages resulting from the use of information contained in the Service,
    • content posted by Users.
  3. Advertisements and commercial offers presented on the website do not constitute an offer within the meaning of the provisions of the Civil Code and other relevant legal regulations.
  4. The Service may contain links to other websites. The Administrator is not responsible for the content and privacy policy of these websites.
  5. All of the above exclusions and limitations of liability apply to the fullest extent permitted by law, covering every type of existing liability, including contractual, tortious, and any other liability provided for in Polish or foreign law.


VIII. FINAL PROVISIONS

  1. The Administrator reserves the right to make changes to the Regulation. Changes will be published on the Service and will enter into force upon their publication.
  2. Matters not regulated in the Regulation are subject to law.
  3. All disputes related to the use of the Service will be settled by the court having jurisdiction over the Administrator’s registered office.

    • User’s consent (Art. 6(1)(a) GDPR),
    • Necessity for the performance of a contract (Art. 6(1)(b) GDPR),
    • Legitimate interests pursued by the Administrator (Art. 6(1)(f) GDPR).

    • Entities providing IT services,
    • Entities providing marketing services,
    • Entities processing data on behalf of the Administrator.

SkyHigh Water Sport Center Regulations

I. GENERAL PROVISIONS

  1. SkyHigh Water Sport Center operates in Italy as an Amateur Sports Association.
  2. Everyone using SkyHigh’s services must join the club and pay a membership fee.


II. MEMBERSHIP AND FEES

  1. Membership in SkyHigh is associated with ensuring safety on the water, including insurance.
  2. SkyHigh is affiliated with UISP (Unione Italiana Sport Per tutti) and IKO (International Kite Organisation).
  3. The membership fee is:
    • 30 euros for adults
    • 15 euros for children up to 16 years of age
  4. The membership fee is valid for one year.


III. BENEFITS INCLUDED IN THE MEMBERSHIP FEE

  1. The membership fee includes:
    • Third-party liability insurance, which protects against financial consequences of events resulting in personal or property damage caused to third parties during sports activities.
    • Use of school facilities, such as:
      • Kids corner
      • Chillout zone
      • Sun loungers
      • Mini ramp
      • Mini gym
      • Basketball court
      • Internet
    • Sanitary facilities, including toilets and outdoor showers.


IV. FEES FOR CAMP PARTICIPANTS

  1. For children participating in KidsCamp or Youth Camp, the fee is 10 euros.


V. FEES FOR INDEPENDENT SAILORS

  1. Individual sailors, using their own equipment, are required to pay an additional fee of 20 euros per week for insurance and equipment storage.


VI. FINAL PROVISIONS

  1. This regulation is effective from the date of its publication.
  2. Any changes to the regulation will be published on the website www.skyhigh.pl and available at the club’s headquarters.
